NM Sustainable Building Tax Credit
Provides transferable tax credits for green-certified buildings in New Mexico through LEED and Build Green certifications.
The NM 2021 Sustainable Building Tax Credit sits under the New Mexico Taxation and Revenue Department and rewards green-certified buildings in New Mexico. It is the successor program to the older sustainable building credit, and certification comes through the New Mexico Energy, Minerals and Natural Resources Department before TRD will recognize the claim. The credit is transferable, uses separate residential and commercial schedules, and includes an affordable-housing multiplier. It applies to buildings that reach certifications such as LEED or Build Green NM, and the annual state allocation is limited, so EMNRD certification timing matters. The program is available until January 1, 2028, which makes the current window finite even though claims can still move through TAP once the building is certified. The strongest applicants are projects that can line up the building code, design work, and certification process early enough to clear the cap and finish before sunset. A clean application depends on documentation that shows the certification level, the building type, and the EMNRD certificate that unlocks the tax credit on the TRD side.
